Terms of the siEmanko! online shop (Regulamin)
This is a translation for convenience. The Polish version of this document is legally binding.
Version of 19 October 2026. In force from 19 October 2026.
§ 1. Who runs the Shop
- 1.The siEmanko! online shop, available at https://esimanko.pl (the "Shop"), is run by Aliaksandr Nazaruk, an entrepreneur carrying on a sole proprietorship entered in the Central Register and Information on Economic Activity (Centralna Ewidencja i Informacja o Działalności Gospodarczej, CEIDG), NIP (tax identification number) 9512452796, REGON (statistical number) 529368437 (the "Seller"). "siEmanko!" is the trading name under which the Seller runs the Shop.
- 2.The Seller's address for service: ul. Marcina Kasprzaka 31 lok. 119, 01-234 Warszawa.
- 3.Contacting the Seller:
- e-mail: [email protected];
- the "Write to support" (Napisz do wsparcia) form in the Account (for signed-in Customers).
- 4.The Seller is not a mobile network operator. Data transmission under the Packages is provided by local network operators in the Customer's country of stay, through the eSIM provider whose services the Seller uses. The party to the Contract with the Customer and the entity responsible to the Customer is the Seller.
- 5.The Seller is listed in the register of VAT taxpayers as an exempt taxpayer (podatnik zwolniony).
- 6.On the same terms the Seller also runs the GlobalPass online shop, available at https://globalpass.pl. Both shops use a shared Account (§ 4(7)).
- 7.The Seller sends e-mails concerning the Account and orders from the address [email protected].
§ 2. Definitions
- 1.Customer — a natural person, a legal person or an organisational unit without legal personality to which the law grants legal capacity, using the Shop or concluding the Contract. An Account may be created by a person of full age. A person who has turned 13 but not yet 18 may create an Account and buy Packages with the consent of a parent or guardian, unless the law allows them to act on their own — for example when they pay with pocket money, their own earnings or from their own bank account. A person who has not turned 13 may not create an Account.
- 2.Consumer (Konsument) — a Customer who is a natural person concluding the Contract not directly connected with their business or professional activity.
- 3.Business with consumer rights (przedsiębiorca na prawach konsumenta) — a Customer who is a natural person concluding the Contract directly connected with their business activity, where the content of the Contract shows that it is not of a professional nature for them, arising in particular from the subject of their business as disclosed in CEIDG. They are entitled to the Consumer's rights described in § 10 and § 11 to the extent provided for by law.
- 4.Account — the Customer's account, shared by the Shop and the GlobalPass shop (§ 1(6)), protected by an e-mail address — with a password or a one-time code sent to that address — in which the Customer sees their eSIMs, their Installation Codes, data usage, refunds and correspondence with support.
- 5.eSIM — a SIM card in electronic form, built into the device. After Installation a second SIM card appears in the phone, through which the internet runs; the Customer's existing SIM card stays in the phone and works as before.
- 6.Package — a data transmission plan offered in the Shop for a specified country or region, with a set amount of data and validity period, described on the Shop's page.
- 7.Installation Code — a QR code and the matching activation code (text), which allow the eSIM to be installed in a device.
- 8.Installation — adding the eSIM to a device using the Installation Code. The moment of Installation is recorded by the eSIM provider and the Seller can check it.
- 9.Contract (Umowa) — the distance contract for the sale of a Package concluded between the Seller and the Customer.
- 10.Terms (Regulamin) — this document.
§ 3. Services provided electronically and technical requirements
- 1.In the Shop the Seller provides the following services electronically, free of charge:
- browsing the offer of Packages and checking whether a given device model supports eSIM;
- maintaining the Account;
- the forms in the Account: "Write to support" and "Ask for a refund" (Poproś o zwrot).
- 2.To use the Shop you need: a device with internet access, an up-to-date web browser with JavaScript and cookies enabled, and an active e-mail address.
- 3.To use a Package you need a device meeting the requirements of § 5(6) and internet access (e.g. Wi-Fi) at the moment of Installation.
- 4.The contract for maintaining the Account is concluded when the Account is created, for an indefinite period. The Customer may terminate it at any time by asking for the Account to be deleted (§ 4(5)). The Seller may terminate it for important reasons (breach of the Terms, a change in the law, the Shop ceasing to operate) with 14 days' notice, by sending a statement to the Account's e-mail address. Termination does not affect the settlement of Contracts already concluded, including refunds due.
- 5.The Customer may not send unlawful content to the Shop, in particular in the support and refund forms.
- 6.Using the internet involves typical risks, such as attempts to obtain passwords by deception (phishing) or malicious software. The Seller never asks for a password in an e-mail. The Installation Code is displayed only in the Account to its signed-in owner — it should not be shared with anyone, because it allows the eSIM to be installed on someone else's device.
§ 4. Account
- 1.Buying a Package requires an Account. To create an Account you need an e-mail address and a password (at least 8 characters) or a one-time code sent to that address (clause 8). The Shop does not ask for a first name, surname, address or phone number.
- 2.All purchased eSIMs are kept under the Account's e-mail address — it should be entered carefully. The Customer is responsible for keeping their password and sign-in codes confidential.
- 3.The Customer may change the password in the Account. After the password is changed, the other devices are signed out.
- 4.A Customer who does not remember the password may set a new one using a link sent to the Account's e-mail address. After a new password is set, all devices are signed out. Important: an eSIM whose Installation Code has never yet been displayed stays locked after such a reset, because access to the e-mail mailbox alone does not confirm the owner's identity. In that case the Customer should write to support from the Account. Because such an eSIM has not been installed, the Customer can also always use § 9 and receive a refund of the whole price. eSIMs displayed earlier remain available.
- 5.The Customer may at any time ask for the Account to be deleted, by writing from the Account's e-mail address to the address given in § 1(3). Before deletion the Seller completes matters in progress (e.g. a refund due). After the Account is deleted, the Customer loses access to the Installation Codes and usage readings; an eSIM already installed works until the end of the Package. The rules for keeping data after the Account is deleted are described in the Privacy Policy.
- 6.A parent or guardian of a minor may write to the address in § 1(3). At their request the Seller closes the minor's Account on the terms of clause 5. If under the law the purchase required the consent of a parent or guardian, there was no consent, and the parent or guardian does not confirm the purchase, the Seller refunds the whole amount paid by the same payment method, no later than within 14 days. The Seller may ask for confirmation that the message comes from the parent or guardian.
- 7.One Account in two shops. The Account is shared by the Shop and the GlobalPass shop: a Customer who has an Account in one of them signs in to the other with the same e-mail address and password, and in the Account sees the eSIMs and purchases from both shops. In each shop they sign in separately — signing out in one does not sign them out in the other. Changing the password (clause 3) and setting a new password (clause 4) apply to the Account in both shops, as does deleting the Account (clause 5), which deletes it in both shops at the same time.
- 8.Signing in with a code. Instead of a password the Customer may sign in with a one-time six-digit code sent to the Account's e-mail address; the code works for 10 minutes and is valid once. If there is no Account at that address yet, signing in with the code creates it. Because the code confirms only access to the e-mail mailbox, an eSIM whose Installation Code has never yet been displayed and which was issued before signing in with the code stays locked until the Customer signs in with a password. eSIMs issued after signing in with the code and eSIMs displayed earlier are available. A Customer who has no password may set one on the terms of clause 4 or write to support; they can also always use § 9.
§ 5. Packages — what the Customer buys
- 1.The description of each Package in the Shop contains at least: the country or region, the amount of data, the validity period and the price, as well as the "Purchase and refund terms" (Warunki zakupu i zwrotu) and the device requirements, visible before payment. These two texts are shown in Polish if the Seller has them in that language, and otherwise in English; under a text shown in Polish, "Original in English" (Oryginał po angielsku) shows the English text.
- 2.A Package is for data transmission only (internet). It does not include a phone number, voice calls or SMS. The Customer's number stays on their existing SIM card; calls through internet messaging apps work, because they use data transmission.
- 3.The validity period of most Packages starts to run when the eSIM first connects to a network in the Package's country or region. Some Packages count it from Installation. A Customer who wants to be sure of not losing days before the trip should install the eSIM just before leaving or after arriving.
- 4.When the Package's data has been used up or the validity period has expired, data transmission stops. Unused data is lost and does not carry over to another period. A Package does not renew automatically and does not give rise to any further charges. Topping up an eSIM is not currently available — to continue using the internet, the Customer may buy another Package.
- 5.An eSIM that is not installed expires after the period set by the eSIM provider — currently 180 days from purchase. After that period it cannot be installed, and the right under § 9 expires on the same day.
- 6.Device requirements. A Package works in a device that supports eSIM and is not locked by an operator (simlock). The list of models in the Shop is an aid, not a guarantee: what decides is whether the device shows an EID number (after dialling *#06#) and whether it has no operator lock. The Customer should check this before buying. If after the purchase it turns out that the device does not support eSIM, the eSIM should not be installed — the Customer may then use § 9.
- 7.APN. Most devices set the access point name (APN) automatically during Installation. If the device asks for it, the Customer will receive the correct value from support.
- 8.Hotspot. Sharing the internet with other devices (hotspot, tethering) is not guaranteed. Whether it works depends on the local network operator and on the device.
- 9.Quality of service. Speed and coverage depend on the local operator's network, the location, the network load and the device. The Seller does not guarantee coverage in every place in the country or region covered by the Package. To avoid charges from their own operator, the Customer should turn on data roaming for the eSIM and turn it off for their existing SIM card.
- 10.The eSIM should not be removed from the device before the end of the Package — reinstalling it is usually not possible. After the Package ends, the eSIM may be removed.
- 11.The Customer uses the Package in accordance with the law of the country in which they are staying, and does not use it for unlawful activities.
- 12.The Seller may refuse to sell or issue an eSIM if doing so would breach sanctions law or other mandatory provisions of law; in that case it refunds the whole amount paid.
§ 6. Prices and payments
- 1.Prices in the Shop are given in złoty (PLN). Every price is a final price: it includes all taxes and there are no additional fees (for activation, delivery or a deposit).
- 2.Payment methods: payment card, Apple Pay and Google Pay (on devices that support them), BLIK and other methods that the payment form shows for a given payment.
- 3.Payments are handled by Stripe Payments Europe, Limited, with its registered office in Ireland. Card data and the BLIK code are entered in the Stripe form and do not reach the Seller.
- 4.Payment is one-off, in advance and in full; the amount is taken immediately after the payment is approved. The Shop does not offer subscriptions or automatic renewal.
- 5.The price confirmed before payment is valid for the time shown on the payment page (currently 30 minutes). If the payment is not made within that time, nothing is charged, and the Customer may choose the Package again. Later price changes in the Shop do not affect orders already paid.
- 6.When paying with a card held in a currency other than the złoty, the Customer's bank may charge a currency conversion fee. Payment with a złoty card or with BLIK takes place without currency conversion.
- 7.Every purchase — with its date, price and currency — is visible in the Account, in the "Purchases" (Zakupy) section. At the Customer's request the Seller issues an invoice; it is enough to write to the address in § 1(3) within 3 months of the end of the month in which the purchase was made.
§ 7. How the Contract is concluded
- 1.To buy a Package, the Customer:
- chooses the Package;
- reads the description of the Package, the "Purchase and refund terms" and the device requirements;
- signs in to the Account or creates one;
- receives the price confirmation;
- ticks both statements above the payment button and pays by clicking the "Buy and pay" (Kupuję i płacę) button with the amount.
- 2.The payment button works only once the Customer has ticked both statements visible above it; neither of them is ticked in advance. Clicking the button means placing an order with an obligation to pay. The Shop records with the order that both statements were made, as well as the version of the Terms and the time. The statements are:
- acceptance of the Terms and confirmation of having read the Privacy Policy;
- the Customer's request for the eSIM to be issued and the provision of the service to begin at once, before the end of the period for withdrawal from the Contract (odstąpienie od umowy) (§ 10), together with the acknowledgement that, by withdrawing within that period, the Customer will pay for the part of the service performed up to the moment of withdrawal, and that once the service has been performed in full they will lose the right to withdraw from the Contract.
- 3.The Contract is concluded at the moment the payment is accepted, that is, when the payment operator confirms that the payment has been accepted. Until then neither party is bound, and a failed payment takes nothing.
- 4.After issuing the eSIM, the Seller sends to the Account's e-mail address a message in Polish saying that the eSIM is ready and how to install it; the message never contains the Installation Code. The description of the purchased Package, the price and the date of purchase remain available in the Account, and the Terms in the Shop. At the Customer's request the Seller sends by e-mail the Terms as worded on the day the Contract was concluded.
- 5.The Contract is concluded in Polish.
- 6.The Terms are available in the Shop at any time and can be saved or printed. The details of orders are available in the Account.
- 7.One Account may have at most three started and not yet paid orders at the same time — in the Shop and in the GlobalPass shop combined (§ 4(7)).
§ 8. Issuing the eSIM
- 1.The Seller issues the eSIM without delay after the payment is accepted — usually within a few minutes. The eSIM then appears in the Account, in the "Your eSIMs" (Twoje eSIM-y) section, which the payment page opens once the eSIM is ready, and the Installation Code is displayed there. The Seller also sends an e-mail notification that the eSIM is ready; the Installation Code itself is never sent by e-mail.
- 2.The Installation Code is displayed only to the signed-in owner of the Account, and every display of it is recorded for the Customer's security.
- 3.In exceptional cases — e.g. with an unusual number or value of purchases on one Account — the Seller may hold the issuing of the eSIM until the order has been checked by a person. The payment page and the Account then show that the order is being checked. If the order is confirmed, the eSIM is issued; if it is not confirmed within the time limit in § 8(4), the Customer receives a refund of the whole amount paid on the terms described in that provision.
- 4.Time limit. The Seller issues the eSIM no later than within 60 minutes of the payment being accepted. If for any reason — including because of a check — the eSIM is not issued within that time, the order is cancelled, and the Customer receives a refund of the whole amount paid by the same payment method, without delay, no later than within 14 days. The Customer does not have to ask for it.
§ 9. Cancellation before Installation — full refund (the Seller's guarantee)
- 1.As long as the eSIM has not been installed, the Customer may cancel the Package and receive a refund of the whole price — for 180 days from purchase, without giving a reason.
- 2.To cancel, the Customer chooses in the Account, next to the purchase concerned, "Ask for a refund" and the reason "The eSIM is not installed and is no longer needed" (eSIM nie jest zainstalowany i nie jest już potrzebny), or writes to the e-mail address in § 1(3).
- 3.The Seller checks with the eSIM provider whether Installation has taken place. Every request is decided by a person, and the decision appears in the Account, in the "Refunds" (Zwroty) section, within 14 days of the request being made.
- 4.The refund goes to the same payment method with which the Customer paid, no later than within 14 days of the request being granted; the bank usually shows it within 5–10 working days. If a refund that way proves impossible, the Seller agrees another way with the Customer, at no cost to the Customer.
- 5.Once the request has been granted, the Customer may no longer install or use that eSIM.
- 6.After Installation, cancellation under this paragraph is not possible: the network resource has been issued and cannot be returned. This does not limit the statutory right of withdrawal (§ 10) or the right to make a complaint (§ 11) — for example when the eSIM was installed but the internet never worked.
- 7.The right under this paragraph is an additional contractual guarantee of the Seller. It does not exclude or limit the rights the Customer has by law.
§ 10. Statutory right of withdrawal from the Contract
- 1.A Consumer and a Business with consumer rights may withdraw from the Contract within 14 days without giving a reason. The period runs from the day the Contract is concluded (§ 7(3)).
- 2.To withdraw, it is enough to submit a statement to the Seller before the period expires — e.g. in the Account ("Ask for a refund"), by e-mail to the address in § 1(3) or in writing to the address in § 1(2). The model form (Annex No. 1) may be used, but this is not obligatory. To meet the deadline it is enough to send the statement before it expires.
- 3.The Seller confirms receipt of the statement by e-mail without delay.
- 4.A Customer who requested that performance begin before the end of the withdrawal period (§ 7(2)(2)) and then withdraws from the Contract pays for the performance rendered up to the moment of withdrawal — in proportion to its scope. If the eSIM has not been installed, this amount is zero and the Customer receives a refund of the whole price.
- 5.The right of withdrawal does not apply if the Seller has performed the service in full with the express consent of the Customer, who was informed before performance began that once it has been rendered they would lose the right of withdrawal, and acknowledged this (the statement in § 7(2)(2)).
- 6.In the event of withdrawal the Seller refunds the amount due without delay, no later than within 14 days of receiving the statement, by the same payment method, unless the Customer expressly agrees to another; the refund involves no costs for the Customer. After withdrawal the Customer may no longer install or use that eSIM.
- 7.If the Customer has both the right under this paragraph and the right under § 9, they may choose the more favourable one.
§ 11. Complaints (reklamacje)
- 1.The Seller is obliged to supply a Package that conforms to the Contract.
- 2.A complaint may be submitted:
- in the Account — next to the eSIM concerned, through "A problem with this eSIM? Write to support" (Problem z tym eSIM? Napisz do wsparcia), or through "Ask for a refund" with the reason: "The eSIM is installed, but the internet doesn’t work" (eSIM jest zainstalowany, ale internet nie działa), "The plan isn’t as described" (Pakiet nie odpowiada opisowi) or "I paid but didn’t receive the eSIM" (Zapłaciłem, ale nie otrzymałem eSIM);
- by e-mail to the address in § 1(3);
- in writing to the address in § 1(2).
- 3.It is worth giving: the e-mail address of the Account whose purchase the complaint concerns, what the problem is and since when it has occurred, the country and network, the device model, and what the Customer demands. This is not a condition of the complaint being considered — it helps resolve it faster.
- 4.The Seller replies to a complaint within 14 days of receiving it, by e-mail or in the Account. If the Seller does not reply within that time, the Consumer's complaint is deemed to have been accepted.
- 5.If information from the eSIM provider or the network operator is needed to consider the complaint, the Seller obtains it itself; in the Account the matter then has the status "With the network operator" (U operatora sieci). This does not extend the time limit in clause 4.
- 6.If the Package does not conform to the Contract, the Customer may demand that it be brought into conformity (e.g. the issuing of a new eSIM or the removal of the fault), and where this is not possible or does not happen within a reasonable time — a reduction of the price or withdrawal from the Contract and a refund of the price, on the terms provided for by law.
- 7.Complaints concerning the electronic services in § 3 (e.g. the operation of the Account) are submitted in the same way.
- 8.Towards Customers who are neither Consumers nor Businesses with consumer rights, the Seller's liability for the Package's non-conformity with the Contract is excluded to the extent permitted by law, and liability for damages is limited to the price of the Package concerned.
§ 12. Liability
- 1.The Seller is liable to the Customer on the terms set out in the law. The provisions of the Terms do not exclude or limit the rights of the Consumer and of the Business with consumer rights arising from mandatory provisions of law.
- 2.The Seller is not liable for a Package not working because of a device that does not meet the requirements of § 5(6), the Customer's removal of the eSIM from the device, or the Customer's passing the Installation Code to a third party.
§ 13. Out-of-court ways of resolving disputes
- 1.A Consumer may use out-of-court ways of handling complaints and pursuing claims, in particular:
- ask for help from a municipal or district consumer ombudsman (rzecznik konsumentów) or a consumer organisation;
- apply to the provincial inspector of the Trade Inspection (wojewódzki inspektor Inspekcji Handlowej) for mediation or to a permanent consumer arbitration court (stały polubowny sąd konsumencki);
- use the entities entered in the register of entities authorised to conduct proceedings for the out-of-court resolution of consumer disputes, kept by the President of the Office of Competition and Consumer Protection (Prezes UOKiK) (www.uokik.gov.pl).
- 2.Participation in such proceedings is voluntary for both parties.
§ 14. Personal data
The controller of Customers' personal data is the Seller. The rules for processing data and Customers' rights — including that the Account is shared by the Shop and the GlobalPass shop — are described in the Privacy Policy, and cookies in the Cookie notice; both documents are available in the Shop.
§ 15. Changes to the Terms
- 1.The Seller may change the Terms for important reasons: changes in the law, changes in payment methods, a change of eSIM provider, a change in the scope of the Shop's services, or the need to ensure security.
- 2.The Seller informs Customers who have an Account of a change by e-mail at least 14 days before it comes into force. A Customer who does not accept the changes may terminate the contract for maintaining the Account (§ 3(4)).
- 3.Contracts concluded before the change are governed by the Terms as worded on the day the Contract was concluded.
§ 16. Final provisions
- 1.The Contracts are governed by Polish law. The choice of law does not deprive the Consumer of the protection afforded to them by the mandatory provisions of the country in which they have their habitual residence.
- 2.Disputes are resolved by the common courts having jurisdiction under the general rules; the Consumer may also bring an action before the court of their place of residence, if the law allows it. Disputes with Customers who are neither Consumers nor Businesses with consumer rights are resolved by the court having jurisdiction for the Seller's address.
- 3.The Terms are available in Polish.
- 4.The Terms are in force from 19 October 2026.
